TERMS OF SERVICE

 

§1. General Provisions

These Terms of Service (”Terms”) govern the use of the Wellsi platform (the “Platform”). The Platform is operated by: Wellsi sp. z o.o. with its registered office in Kraków, ul. Praska 34b/68, entered into the Register of Entrepreneurs of the National Court Register under the number: 0001056762, Tax Identification Number (NIP): 6762650863, National Business Registry Number (REGON): 526321122, hereinafter referred to as “Wellsi”, “we”, or the “Service Provider.” These Terms constitute the terms for the provision of electronic services. By using the Platform, the user accepts these Terms.

 

§2. Definitions

User – a natural person using the Platform. Account – an individual user account on the Platform. Subscription – paid access to selected Platform features. Specialist – an independent professional cooperating with the User through the Platform. Privacy Policy – the document describing personal data processing rules.

 

§3. Nature of the Platform

The Platform is a technology-based, educational and supportive tool. Wellsi: is not a healthcare provider, does not provide medical services, does not conduct medical activity, is not a medical device.

The Platform is not intended for diagnosis or treatment. The Platform must not be used in emergencies or life-threatening situations. In such cases, users should contact appropriate medical or emergency services.

 

§4. No Medical Advice

The content available on the Platform is for informational and educational purposes. It does not constitute medical advice or diagnosis. Health-related decisions are made by the User independently or with a qualified professional.

 

§5. User Account

Use of the Platform requires creating an Account. Users must provide accurate and truthful information. Users are responsible for keeping login credentials secure. Sharing an Account with third parties is prohibited.

 

§6. Health Data and Consent

Some features require providing health-related data. Health data is processed only based on the User’s explicit consent. Refusal or withdrawal of consent may limit access to certain features. Details are described in the Privacy Policy.

 

§7. Cooperation with Specialist

The Platform may enable contact with Specialist. Specialist: act independently from Wellsi, provide services on their own behalf, bear their own professional responsibility. Wellsi is not a party to any therapeutic or professional relationship. Specialist can access User data only within the Platform environment.

 

§8. Communication and Chat

The Platform may offer chat or messaging features. Chat must not be used for emergencies. Users should not share unrelated or excessive personal information.

 

§9. Subscriptions and Payments

Some Platform features may be paid. Subscriptions renew automatically unless cancelled. Pricing and billing periods are shown before purchase. Price changes do not affect already paid billing periods. Consumers retain rights under applicable consumer law.

 

§10. Right of Withdrawal (EU Consumers)

Consumers may withdraw from a distance contract within 7 days. The right of withdrawal may not apply once digital service performance has started with the user’s prior consent, in accordance with EU law.

 

§11. Account Deletion

Users may delete their Account at any time. Deletion is carried out within a reasonable technical timeframe. Paid fees are non-refundable unless required by law.

 

§12. Complaints

Complaints may be submitted to: halo@wellsi.app Complaints should include a description of the issue. Responses are provided within up to 30 days.

 

§13. Intellectual Property

Platform content is protected by copyright and other IP laws. Users receive a limited, non-exclusive license for personal use. Copying, distributing, or modifying content without consent is prohibited.

 

§14. Acceptable Use

Users must not: violate laws, attempt to breach security, misuse the Platform.

 

§15. Security

Wellsi applies industry-standard security measures but cannot guarantee absolute security in internet communications.

 

§16. Liability

Wellsi is not liable for: Users’ health decisions, actions of Specialists, outcomes of exercise programs, technical interruptions. Liability is limited to the extent permitted by law.

 

§17. Data Protection and Cookies

Personal data processing is governed by the Privacy Policy. Cookies usage is governed by the Cookies Policy.

 

§18. Changes to Terms

These Terms may be updated. Users will be informed about material change.

 

§19. Governing Law

These Terms are governed by Polish law, unless mandatory consumer law provides otherwise.
